What can I do if the oral surgeon accidentally left part of my wisdom tooth in after extraction?

I had my wisdom teeth taken out. one was impacted so they cracked it into pieces and removed it. I had pain in that one area for a while, went back, and he just gave me more antibiotics and vicodin.

its been slightly painful ever since, but manageable. now its been a few months and i had a sharp thing sticking out of the area. I pulled it out with tweezers and a long shard of tooth, down to the root came out. I bled like crazy.

So the guy never took out all the tooth and i was in pain for months and he just kept giving me more medicine. can i get a refund or sue or something? i saved the part of the tooth i pulled out…
